.Résumé
The Succession System When a person dies, the succession of that person, called the “de cujus,” opens at the place where the deceased had their domicile or principal residence at the time of death (Article 755). The rights and obligations of the “de cujus” constitute the estate transferred to the heirs and legatees in accordance with the law (Article 756). The succession may be either intestate or testamentary. All or part of the property not disposed of by will is transferred to the intestate heirs. Articles 758 to 772 of the Family Code organize the succession system into four categories. The first category is assigned to the children of the “de cujus,” born within or outside arriage but recognized during the lifetime of the “de cujus,” including adopted children, forming the first category of heirs (Article 758). Paragraph 2 of the same article specifies that children of the “de cujus” who died before him or her are replaced by their descendants. The second category is divided into three groups: The surviving spouse The father and mother of the “de cujus” The brothers and sisters of the “de cujus” (Article 758 paragraph 2) The third category consists of the paternal uncles and aunts of the deceased. Representation by descendants is permitted (Article 758 paragraph 3)
